These Terms govern your use of tryfortyfive.com (the "Site") and any purchase you make from Forty-Five ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms.

4. Products and pricing
We aim for accuracy in product descriptions, images, and pricing, but we don't warrant that all content is error-free. We reserve the right to correct errors, change prices, and refuse or cancel any order — including after an order is placed — at our discretion. If we cancel an order you've paid for, we'll refund you in full.
Product images are illustrative. Packaging and formulation may vary.
5. Orders and payment
Your order is an offer to buy. A confirmation email acknowledges receipt but does not constitute acceptance; acceptance occurs when we ship. Payment is taken at checkout. All prices are in USD and Include VAT.
6. Subscriptions ⚠️
If you enroll in a subscription, you authorize us to charge your payment method on a recurring basis at the stated interval until you cancel. You may cancel at any time before your next billing date via your account page or by emailing us. Cancellation takes effect for future orders; orders already processed are governed by our Return and Refund Policy.
⚠️ If you offer subscriptions, review this against Shopify's subscription requirements and, for US customers, FTC negative-option rules — these require clear disclosure before checkout and simple cancellation.
7. Shipping and risk
Shipping terms are set out in our Shipping Policy. Risk of loss passes to you on delivery. You are responsible for any import duties, taxes, or customs charges in your country.
8. User content
If you submit a review, photo, or comment, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our business. You confirm the content is your own and doesn't infringe anyone's rights. We may remove content at our discretion.
9. Intellectual property
All content on this Site — text, images, logos, design, and the Forty-Five name — is owned by us or our licensors and protected by intellectual property law. You may not reproduce or use it commercially without our written permission.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising from your use of the Site or any product is limited to the amount you paid for the product in question. We are not liable for indirect, incidental, or consequential losses.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded. Your statutory consumer rights are not affected.
11. Governing law ⚠️
These Terms are governed by the laws of EU, and disputes are subject to the courts of EU LAW. If you are a consumer in the EU/EEA, you retain the protection of the mandatory consumer laws of your country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform.

We may update these Terms at any time. The version posted at the time of your order governs that order.
